Support Group Sues Indiana Over Specialty License Plate Denial

Indiana Youth Group is a non-profit organization that supports young people who identify as LGBT and those who are questioning.  The group claims that the Indiana state Bureau of Motor Vehicles discriminated against them in not approving a specialty license plate for them.  Custom plates can generate revenue for groups and also promote the group, with their special logo on the plate.  For an application to receive approval, the organization must demonstrate, "an uncommon level of statewide distinction and benefit to the citizens of Indiana that sets the organization and its purpose for the plate apart from others."  The group accuses the BMV of lacking clear standards in evaluating plates and violating their First Amendment rights by using unilateral discretion in ruling on applications. The American Civil Liberties Union of Indiana filed a lawsuit on the group's behalf in U.S. District Court on Thursday.  The group is represented by Gavin Rose and Kenneth Falk.Related Media Coverage:News-Sentinel - September 27, 2010"Ind. sued over specialty plate denial"http://www.news-sentinel.com/apps/pbcs.dll/article?AID=/20100927/NEWS/9270322Courthouse News - September 26, 2010"Gay support group wants license plate"http://www.courthousenews.com/2010/09/27/30601.htm
