Plaintiffs of Perry v. Schwarzenegger File Briefs in Proposition 8 Case

The plaintiffs in Perry v. Schwarzenegger filed a brief with the Ninth Circuit Court of Appeals on Monday asserting that the law is unconstitutional.  Theodore Olson and David Boies, the lead attorneys to the plaintiffs commented in the brief that, "Fourteen times the Supreme Court has stated that marriage is a fundamental right of all individuals. This case tests the proposition whether the gay and lesbian Americans among us should be counted as ?persons? under the 14th Amendment, or whether they constitute a permanent underclass ineligible for protection under that cornerstone of our Constitution."  In addition, lawyers for the city of San Francisco filed briefs to counter an appeal by Proposition 8's sponsors.  The lawyers claim that the sponsors did not make a sound case for the prevention of marriage equality, while still allowing lesbian and gay couples to adopt children.
