Maryland Senator May Support Marriage Equality Legislation

State Sen. James Brochin (D-Baltimore County) may alter his position on Maryland?s proposed marriage equality legislation. Though Brochin previously expressed opposition to marriage equality while supporting civil unions for all couples, he announced on Wednesday that he is reconsidering his stance. His announcement comes after a seven-hour hearing on the legislation held this Tuesday, during which Brochin said he found the testimony of the opposition particularly ?appalling.? Twenty-four votes are needed to pass the marriage equality bill in the Senate, and so far 20 Senators have committed to vote in approval. Brochin?s vote could prove crucial to the bill?s survival, as advocates say they are gathering more support. Prop 8 backers target trial judge in urging appeal

SAN FRANCISCO (AP) – Backers of California’s same-sex marriage ban urged a federal appeals court to overturn the trial judge who struck down Proposition 8 by arguing late Friday that his consideration of evidence was “egregiously selective and one-sided.”

In written arguments to the 9th U.S. Circuit Court of Appeals, lawyers for the ban’s sponsors alleged that Chief U.S. Judge Vaughn Walker “quite willfully” disregarded a 1972 U.S. Supreme Court precedent and other relevant information when he decided the voter-approved measure was an unconstitutional violation of gay Californians’ civil rights.

Rhode Island Surrenders. Marriage Equality Bites the Dust. Again.

The Speaker of the Rhode Island House of Representatives, Gordon Fox, officially conceded today that there is not enough support in the Legislature to pass a marriage equality bill.


House Speaker Gordon Fox, who is gay and is a leading supporter of the gay marriage bill, says that it's clear the bill won't overcome opposition in the Senate. Fox, a Providence Democrat, says he'll instead sponsor civil union legislation giving same-sex couples the same state rights given to married couples.

The announcement deals a major setback to advocates of gay marriage in the Ocean State. They had called civil unions a poor substitute for full marriage. Senate President Teresa Paiva Weed's opposition was seen as a key obstacle to the bill's passage. In a statement to reporters, she says she supports civil union legislation and is confident it will pass.
Despite polling on the issue that has repeatedly and consistently showed broad-based support for marriage equality in Rhode Island, its Legislature could not find the courage to support what the majority of Rhode Islanders support.

Instead, in what is becoming a trend, Rhode Island seems likely to join Delaware, Illinois and Hawaii in this year passing 'everything but marriage' civil unions legislation. And unless New York State somehow manages to find at least six Republican legislators to vote for marriage equality, the prospect of any state legislature enacting same-sex marriage legislation in 2011, or even 2012, seems dim.

What has seemed inevitable giving polling trends -- state-by-state marriage equality -- now seems dangerously close for the foreseeable future to shifting into neutral with a strong possibility to move into reverse (New Hampshire).

Here is Speaker Gordon Fox's letter to his colleagues in the House. Read it and weep.


Dear Colleague:

Although my personal position on marriage equality has not changed, I have always been a practical person and I believe my pragmatism is one of the reasons why I was elected Speaker of the House.

I recognize that this is a chamber comprised of members who represent very different constituencies, beliefs, and priorities that must be balanced. Based on individual discussions with many of you, I understand how difficult the marriage equality issue has been.

Based on your input, along with the fact that it is now clear to me that there is no realistic chance for passage of the bill in the Senate, I will recommend that the House not move forward with a vote on the marriage equality bill during this legislative session. I will instead support full passage of a civil unions' bill that grants important and long overdue legal rights to same-sex couples in Rhode Island.

I have had conversations with Senate leadership and, unlike the marriage equality bill, I am optimistic that a civil unions' bill can gain passage in both chambers during this legislative session.

The new civil union bill is currently being drafted and will soon be ready for introduction and public inspection. I will be one of the sponsors.

Because of the federal Defense of Marriage Act (DOMA) passed by Congress in 1996, the federal government does not recognize same sex marriages and therefore federal rights are not granted to same sex couples who get married in states that allow it. For example, same sex partners married in Massachusetts are not granted federal rights such as the right to file joint federal tax returns.

Even with passage of a marriage equality bill such as the one currently pending in our House Judiciary Committee, same sex couples married in Rhode Island would not be given access to those federal rights. However, passage of the civil unions' bill that I will be supporting will grant same sex couples all state rights guaranteed to married couples in Rhode Island. I believe passage of such a measure will be a significant accomplishment in helping to ensure equality to all Rhode Islanders.

As both a long-time supporter of marriage equality and a sponsor of the bill, this is not a decision that I have reached without deep thought, long deliberation, and emotional debate in my own mind and heart.

Throughout my 19 years as a State Representative, I have always worked under the guiding principle that a leader must make a pragmatic decision to forge a path to achieve positive results. With that principle in mind, I am confident that we will quickly obtain the necessary support and votes in both chambers to secure these important and necessary rights for all same-sex couples in Rhode Island.

From the outset of this session, I made a commitment to both the House members and to all our citizens that while I would address the inequalities that exist for same-sex couples in their everyday life, there are other pressing issues that the House must address as well. The passage of our state's budget during these difficult economic times remains paramount.

Today, I publicly renew my commitment to ensuring the granting of important legal rights to partners in committed relationships throughout Rhode Island. I hope for swift passage of a civil unions' bill in the weeks ahead, as well as many other significant pieces of legislation, including our state's challenging budget.

This is triply sad.

By not allowing a vote, Rhode Island voters, just as in Maryland, will not know which of their legislators support marriage and equality and which do not.

Furthermore, Speaker Fox is being less than truthful when he argues that DOMA means that a civil unions bill will be equivalent to a marriage equality bill.

Let's not even consider the reasoning put forth in Judge Vaughn Walker's decision in Perry v. Schwarzenegger (the Proposition 8 trial) destroying the notion that a civil union is constitutionally equivalent to a marriage. The truth is that should DOMA be repealed, same-sex couples who are married will be entitled to those federal benefits he speaks of, while those who are entered into civil unions will not (at least until Congress says they are). Fox is obviously making the best he can of a shit sandwich. Still, he could at least be honest with his colleagues and his constituents.

Finally, while the LGBT community has been out celebrating a satisfying yet ephemeral victory in getting King & Spaulding to drop the DOMA case (the defense, by a top-ranking lawyer, will go on), Maggie Gallagher, NOM and the Religious Right have just notched up another real victory on their trophy belt.

Not only has the newly elected conservative majority in the New Hampshire legislature tried to repeal marriage equality, they are also taking aim at the anti-bullying bill that passed with bi-partisan support in 2010, and is regarded by anti-bullying organizations as a national example of a proactive and inclusive policy. It contains specific protections for LGBT students and allows schools to address cyber and off-campus bullying that interferes with a student's education.

Gareth Davies took the monumental step of coming out as a gay rugby player last year. He is now a role model for many gay teens and adults as well as breaking down gay stereotypes.

Virginia House Kills Bills Affecting National Guard LGBT Service Members

On Tuesday, a Virginia House committee dismissed two bills addressing the status of gay and lesbian service members in the Virginia National Guard. House Bill 2474, sponsored by Del. Robert G. Marshall (R-Prince William) proposed a ban on allowing gay and lesbian service members to serve openly, while House Bill 2345 asked that the Virginia National Guard adhere to the regulations followed by the U.S. Department of Defense. The House Rules Panel rejected HB 2474 on the grounds that the disparity between the National Guard?s standards and those of other armed services could lead to a "management and leadership nightmare" should they ever serve together. Del. Bill Janis (R-Henrico) also noted the possibility of federal funding being compromised by the change. Executive Director of Equality Virginia, James Parrish, argued that the issue should be deferred to the governor and the Guard?s leadership. HB 2345, sponsored by Del. Joseph D. State Attorney General Asks California Court to Lift Stay on Marriage Equality

On Tuesday, a letter from the State Attorney General Kamala Harris, in collaboration with the lawyers for two gay couples and the city of San Francisco, asked the 9th U.S. Circuit Court of Appeals to allow marriage equality to resume in California. In the letter, Harris wrote, "The public interest weighs heavily against the government sanctioning such discrimination by permitting it to continue." Marriage equality has been on hold in the state while the 9th Circuit Court considers an appeal by Proposition 8?s sponsors of a trial judge?s ruling against the ban. The appeals court is awaiting direction from the California Supreme Court, which reiterated Tuesday that it would need at least until the end of the year to consider to the constitutionality of allowing ballot proposition sponsors to defend their measures in court when state officials will not. Former Gov. Arnold Schwarzenegger and current Gov. Landmark Bill Introduced In Senate Today To Ban Workplace Discrimination Based On Gender Identity And Sexual Orientation

WASHINGTON – A landmark bill was introduced in the Senate today that would, for the first time, make workplace discrimination based on sexual orientation and gender identity illegal in most workplaces. The Employment Non-Discrimination Act (ENDA) was introduced by Sens. Jeff Merkley (D-OR), Mark Kirk (R-IL), Tom Harkin (D-IA) and Susan Collins (R-ME). A companion bill, introduced by Rep. Barney Frank (D-MA), was formally introduced last week in the House.
Gaps in existing state civil rights laws leave many LGBT people and their families vulnerable to employment discrimination based purely on who they are. Currently, it remains legal in 29 states to fire or refuse to hire someone for being lesbian, gay or bisexual, while transgender workers can be denied or refused jobs in 37 states. ENDA would create a federal protection that would make certain that all LGBT Americans can exercise their right to make a living free from discrimination.

“ENDA would bring an end to the devastating effect that workplace discrimination has on American families. The right to work free from baseless discrimination shouldn’t be denied to any American and should not hinge upon a person’s gender identity or sexual orientation. Working Americans should not be forced to deny and hide themselves or their families and loved ones in order to hold a job.
“With bills introduced with substantial and bipartisan support in both the House and Senate, Congress has no excuse not to pass ENDA this year.”

Georgia House Rep. Franklin Opposes "Don't Ask, Don't Tell" Repeal

Georgia State Rep. Bobby Franklin (R-East Cobb) has proposed a number of legislative initiatives to correct what he believes are unjust policies held by both the state and national government. In defending his positions, Franklin has cited the U.S. Constitution, the Magna Carta and the Bible. The corrections Franklin plans to make include mandating that the state make all transactions in gold and silver, allowing Georgia residents to keep rabbits, goats and chickens, and repealing government regulation of driver?s licenses and vaccinations. Franklin also opposes the repeal of the military?s ?Don?t Ask, Don?t Tell? law, saying that along with thieves, gay and lesbian people should not be allowed to serve in the armed forces. First elected to the Georgia House of Representatives in 1996, Franklin ran unopposed in November?s general election. Nation's First Out Lesbian Judge Retires from San Francisco Court

Mary Morgan, the nation?s first openly gay judge, announced her retirement from the San Francisco Superior Court on Friday.  Judge Morgan, 65, was appointed to the municipal court in 1981 by recently re-elected Gov. Jerry Brown. In 1993, Morgan left the court and moved to Washington D.C., where she ran a domestic violence legal clinic and worked in the Justice Department. She was named to the Superior Court in 2003 by former Gov. Gray Davis. The court now has 10 gay and lesbian judges. It's hard to believe that a little more than a week ago I was in a hot dry place with plenty of sunshine surrounded by thousands and thousands of lesbians. Today I sit here at my computer, looking out on a cold and rainy day with only my dog by my side. Sigh. But, hey, at least I got to go to Dinah Shore weekend in Palm Springs. Iowa GOP Moves to Impeach Justices for Marriage Equality Decision

The Iowa GOP has "filed four articles of impeachment, one for each remaining member of the Iowa Supreme Court that participated in an April 2009 decision that struck down a legislative ban on same-sex marriage as a violation of the state?s equal protection clause," the Iowa Independent reports.
The four House resolutions target Supreme Court Chief Justice Mark Cady (HR 48) and Justices Brent Appel (HR 47), Daryl Hecht (HR 49) and David Wiggins (HR 50) for ?malfeasance in office? specifically for their ruling in the Varnum v. Brien case, saying that each justice ?exercis[ed] functions properly belonging to the legislative and executive departments.?
The four GOP lawmakers offering the resolutions were Reps. Tom Shaw of Laurens, Dwayne Alons of Hull, Betty De Boef of What Cheer, Glen Massie of Des Moines and Kim Pearson of Pleasant Hill.

Bob Vander Plaats, the anti-gay activist who led the drive to remove the Justices and heads The Family Leader, has previously called for the resignation of the entire Supreme Court and advocated for their removal over the marriage equality ruling in Varnum v. Brien. He is also building ties with likely presidential candidates as Gingrich, Tim Pawlenty, Michele Bachmann, Rick Santorum, Ron Paul and Herman Cain have either addressed or plan to speak during The Family Leader?s ?presidential lecture series.?
Iowa's Governor Terry Branstad, who has expressed his desire to have the judges removed by vote when they are up for retention, said in January that he didn't not believe impreachment was an appropriate measure to be taken.

Watch: Memphis LGBT Center Faces Financial Shutdown; Memphis Residents Speak Out About Gay Rights

The Memphis Gay and Lesbian Community Center is facing shutdown over financial issues after 22 years in operation, ABC24 reports:
"The goal is to raise $45,000 by the end of May,? explained Christy Tweddle, chairwoman of the Center's Board.Without that money, the Center would ?have to let go of our only employee, and our only employee runs all the programs for which we get grant money, which keeps our programs and services open,? she said. She said those programs and services are hard to find elsewhere.?We have the YES program, which is a homeless gay youth outreach, we're the only place in 200 miles square that does anything remotely close to that,? Tweddle said, also pointing out that the Center offers after-hours HIV testing. Tweddle said the Center relies mostly on donations, a funding stream that has dried up because of the economy.

North Carolina Authorities Investigate House Fire as Arson

The home of a gay couple in Clayton, North Carolina, was destroyed by a fire early Friday morning. According to Johnston County Sheriff Steve Bizzell, the incident is being investigated as arson. The couple, who were out of town at the time, are now residing in a motel and are receiving food and clothing from the Red Cross. They asked that local journalists not reveal their names out of safety concerns. Neighbors report that the couple has suffered harassment before. One neighbor cited three specific incidents, including a note containing derogatory language, an anti-gay slur written on the couple?s house and having the tires on one of their cars slashed. Sheriff Bizzell confirmed that he was aware of two of the incidents, but he would not go into detail. Another neighbor expressed sympathy for the couple, saying that they lost everything in the fire. Openly gay candidate Jesse Walters won a seat on the city council of Miami Shores, Florida, just days after discovering his campaign signs were defaced with anti-gay slurs. Walters, who initially felt threatened and unsettled after finding the defaced signs on Sunday, said the support he has received since ??has just been so wonderful. Portuguese Model Accused of Killing Journalist Pleads Not Guilty

This Tuesday, Portuguese model Renato Seabra pleaded not guilty for the murder of 65-year-old Carlos Castro. Castro, who was a prominent journalist in Portugal, was found dead last month in his room at the Intercontinental Hotel in Times Square. He had been beaten and castrated, though the medical examiner?s office revealed that the ultimate cause of death was head trauma and strangulation. Castro?s face was bruised and had shoe impressions. Despite his plea, 21-year-old Seabra has admitted to stabbing and castrating Castro with a corkscrew, noting that the whole attack took at least an hour. Seabra?s attorney, David Touger, said he plans a ?vigorous defense? for Seabra. Poster for the French Gay Pride: The debate rages on

A few days ago, Inter-LGBT, the organizational committee of the French gay pride, has revealed the poster for the 2011 edition. And it created quite a buzz!

When I saw it online the other morning, I spit my coffee. Through my nose. And straight onto my new keyboard. Make sure to empty your mouth and check it out:



The sweet irony is that this year and for the first time, a communication agency has designed the poster, not volunteers like for the previous editions. What bothers me here is that even though an agency can’t be held responsible for everything, since they work according to a brief, this one’s visually ugly. Isn’t it the era of graphic design? I mean, they could have designed a good looking rooster instead of using this picture. I don’t like this rooster’s eye. I find it scary.

I’m fully aware that designing for the LGBT community is a challenge. It’s hard to avoid the clichés and include the L, G, B and T in a single visual. A few years ago, I was part of the LGBT film festival of Grenoble and every year we organized a poster contest to promote the new edition. And every year I would end up crying, yelling or, well, sulking. Most submissions we received represented only men, used all the possible clichés or displayed a poorly photoshopped rainbow. Frustrating, to say the least, and the source of heated discussions.

This one poster bothers me, and not just because it’s ugly. Like a lot of people, I’m uncomfortable with the use of nationalist symbols like the rooster and the red and blue, at a time where the French LGBT community has no reason to be proud of its country. These are the symbols traditionally used by extreme right parties in France. I would have found it funny if this had been a poster released before the 2012 election to call the LGBT upon to vote. That would have been funny, in a sarcastic kind of way. But right now, using the symbols of a republic that’s being repressive towards gays and lesbians to promote an event that’s more festive than political seems… wrong.

Asked about the poster, Inter-LGBT spokesperson Nicolas Gougain says that he regrets that some people seem to believe that those symbols are those of extreme right party Front National:


A symbol of the Republic or nation must not belong to the extreme right only.

I agree with him, but let’s face it: it is exactly the case nowadays. Is Pride the right place to fight this? Besides, there are other ways to use national clichés or symbols: check out the poster for the Euro Pride in Roma. I think it’s brilliant, and the perfect counter-example of the French one.



We are a minority that needs visibility and acceptance and I’m not sure that the use of third degree ‘humor’ is a smart choice. We might be able to get it, but do we want to scare straight people off by sending mixed signals? I mean, it’s not only about the rooster. Look at that boa. Do we really need to use the same old clichés to communicate around our identity?

Nicolas Gougain sees it as “gender bending”. Uh. How can you talk about gender bending when genders are not even represented in the poster? Once again, the LGBT community is reduced to men. Only this time, it’s not even flattering for them: in French, the phrase ‘proud as a rooster’ refers to a rather arrogant, macho man. Pride is also about unity, about getting together. This poster divides. There are groups on Facebook and hundreds of comments and posts on French LGBT websites and blogs. Creating the buzz is good. What’s a failure in my book is dividing a community which usually finds strength in its unity.

Obama, Gay Marriage, and Executive Power

As Matt Welch noted
yesterday, the Obama administration has announced it will no longer
defend the Defense of Marriage Act in court.
According to Attorney General Eric Holder, ?the President and
[the Attorney General] have concluded that classifications based on
sexual orientation warrant heightened scrutiny and that, as applied
to same-sex couples legally married under state law then, from that
perspective, there is no reasonable defense of DOMA.?
At the Volokh Conspiracy, George Washington University law
professor Orin Kerr wonders if this action
sets a dangerous precedent for the expansion of executive
power:

By taking that position, the Obama Administration has moved the
goalposts of the usual role of the Executive branch in defending
statutes. Instead of requiring DOJ to defend the constitutionality
of all federal statutes if it has a reasonable basis to do so, the
new approach invests within DOJ a power to conduct an independent
constitutional review of the issues, to decide the main issues in
the case ? in this case, the degree of scrutiny for gay rights
issues ? and then, upon deciding the main issue, to decide if there
is a reasonable basis for arguing the other side. If you take that
view, the Executive Branch essentially has the power to decide what
legislation it will defend based on whatever views of the
Constitution are popular or associated with that Administration. It
changes the role of the Executive branch in defending litigation
from the traditional dutiful servant of Congress to major
institutional player with a great deal of discretion.
If that approach becomes widely adopted, then it would seem to
bring a considerable power shift to the Executive Branch. Here?s
what I fear will happen. If Congress passes legislation on a
largely party-line vote, the losing side just has to fashion some
constitutional theories for why the legislation is unconstitutional
and then wait for its side to win the Presidency. As soon as its
side wins the Presidency, activists on its side can file
constitutional challenges based on the theories; the Executive
branch can adopt the theories and conclude that, based on the
theories, the legislation is unconstitutional; and then the
challenges to the legislation will go undefended. Winning the
Presidency will come with a great deal of power to decide what
legislation to defend, increasing Executive branch power at the
expense of Congress?s power. Again, it will be a power grab
disguised as academic constitutional interpretation.

Late Sunday night 26 year old Damian Furtch was brutally gay bashed after leaving a MC Donalds in the West Village in New York City.
In a statement Furtch shared with GLAAD yesterday, he says:"The attack against me is part of the larger issue of violence against gay and transgender people in New York City. While I am grateful for the opportunity to share my story, I hope to shed light on the larger issue of violence against my community. This has to stop. Under no circumstance should a person be attacked for their sexual orientation."
Damian�s attack is the second gay bashing this month in New York City. Late February 26 year old Barie Shortell was gay bashed a block away from his home in Williamsburg, Brooklyn.
Action group Right to feel Safe is fed up and has taken the initiative to organize a march against hate crime. Right to feel safe consists of a group of friends of Damian Furtch who each have dealt with anti gay violence in the past.
Right to feel Safe broad support all around the world. Queen of electroclash; Peaches participates by creating an inspiring video to supports efforts of ?Right to feel safe?.
The march will take place on April 10th starting at 3.30 pm at Washington Square park and will lead to the location where Damian was beaten after which it will end at the Stonewall inn; location of the historical Stonewall riots.
Right to feel Safe: ?It is extremely important to us that we end our March at the Stonewall inn because it shows that we will never forget our history and that we will keep fighting for the rights that generations before us fought for with blood, sweat and tears.
?We are dealing with a global trend here that needs to be stopped now!? ?It seems that gay bashing is prevalent even in some of the most liberal cities in the world and that is something that just simply cannot be tolerated!?
After a 24 percent increase in gay violence in 2010, Right to feel safe organized two Marches against gay bashing in former gay capitol Amsterdam, Netherlands.
 Right to feel Safe feels LGBT communities have come to a boiling point:?For over forty years we have been actively and openly fighting for our rights.? ?It is time we get what we have been fighting so hard for: full equality and for all!?

Transgender Woman Announces Candidacy for Mayor of Amarillo, Texas

Sandra Dunn, a 53-year-old transgender woman from Amarillo, Texas, announced her candidacy for mayor at a news conference on Thursday.  According to Dunn, friends encouraged her to run for mayor partly to oppose candidate David Grisham, who gained media attention last year when he called for a boycott of Houston after the election of openly gay Mayor Annise Parker. Watch: Chair of Maine's 'Yes on 1' Campaign, Which Banned Same-Sex Marriage, Expresses Regret in New Doc

Question 1 is a new documentary shot during Maine's successful "Yes on 1" campaign to overturn the state's marriage equality law, utilizing interviews with players on both sides.
The Portland Press Herald rightly reports that the take-away in this documentary, which was filmed during the campaign on the condition that it not be screened before the election, is the regret expressed by the leader of the anti-gay initiative.
Says Marc Mutty, public affairs director for the Roman Catholic Diocese of Maine, and chair of the "Yes on 1" campaign in the film's trailer:
"This has been a f**kin' son of a bitch. This has been awful. I hate it. I hate it. I hate it...I fear I'll be remembered for the work I did on this campaign...[I'm asking...] for forgiveness for the ways in which I might have betrayed my own self in this endeavor."

Navy Expects to Complete Training for "Don't Ask, Don't Tell" Repeal in June

The Navy announced this Tuesday that it expects to complete its program for training personnel for the implementation of the repeal of "Don't Ask, Don't Tell" by June 30. A spokeswoman for the Pentagon said they received training plans on Friday from all military services, which were in turn provided with final teaching materials. The training programs are required to include one phase for chaplains, lawyers and civilian public affairs officers, another phase for commanding officers, and a final phase for rank and file. According to a message sent to sailors this Tuesday, the Navy expects to complete its training program for commanders by April 30 and for all other personnel two months later. The Navy is the only military service to have made the details of its training program public. Pentagon spokeswoman Eileen Lainez said that the other services could not provide details at this time, though they are preparing to begin their training programs. The repeal of ?Don?t Ask, Don?t Tell? will officially take effect two months after President Obama, Defense Secretary Robert M. Gates, and Joint Chiefs of Staff Chairman Adm. Being that she was displaced as a youth, it took her many years to find herself and realize her potential. She joined the Sheriff’s Department in 2006 and later joined the Army Reserves in 2008. Her relationship at that time had gone sour after she signed the contract because her ex did not agree with gays in the service. However Monica disagreed and felt it was an honor to represent GLBT people anyway and anywhere she could.
